Overview of the workshop to gather feedback on the draft Law on Amendments and Revisions of the Law on Technology Transfer – Photo: National Assembly

The workshop recorded many opinions from committee members, representatives of ministries, corporations, and research institutes. The issues discussed included technology transfer policies, technology and investment project appraisal processes, technology valuation, and regulations on capital contributions in the form of technology.

Regarding administrative procedures (Articles 29 and 30), Ms. Nguyen Thi Kim Anh, Member and Deputy of the National Assembly's Committee on Science, Technology and Environment, suggested that the Government should be given the authority to regulate the details. This view aims to follow the current trend in lawmaking where framework laws only stipulate principles.

Regarding the content of technology transfer (amendment and supplement to Clause 1, Article 6), Mr. Hoang Nang Khang, Deputy General Director of Vietnam Railways Corporation, proposed clearly adding the transfer of documents related to design. This aims to ensure a complete technical basis for production and manufacturing.

Regarding the regulations on technology assessment (Article 13), a representative from the Military Telecommunications Industry Group – Viettel – stated that while the draft Law has abolished Articles 14 to 20, Article 13 currently lacks clear provisions on technology assessment. Therefore, Viettel proposes adding a provision entrusting the Government with providing specific guidance on matters related to technology assessment at various stages of investment project implementation.

On behalf of the drafting agency, Deputy Minister of Science and Technology Hoang Minh explained and stated that all contributions regarding valuation, technology appraisal authority, and decentralization of regulations on capital contribution would be fully recorded and incorporated to finalize the draft law for submission to the National Assembly.

In his concluding remarks, Deputy Chairman Nguyen Phuong Tuan suggested that the drafting agency should continue to review the consistency of the draft Law with other related laws currently being developed (for example, the High-Tech Law, laws related to digital transformation) to ensure consistency and avoid overlaps in the law-making process.
